Protection of Personal Data

Under the Law No. 6698 on the Protection of Personal Data (“KVKK”), any information that enables the identification of a real person is considered personal data. TERRA POWER AUTOMOTIVE AND ENERGY IMPORT EXPORT CO. LTD. (TERRA POWER) would like to inform you about the processing purposes, legal reasons, collection methods, to whom and for what purposes personal data may be transferred, and your rights under the KVKK, both related and unrelated to such purposes, with respect to your personal data at TERRA POWER (TERRA POWER reserves the right to update this Privacy Notice on the Protection of Personal Data in accordance with any changes that may be made to the relevant legislation).

1. Methods of collecting personal data

As the data controller, TERRA POWER processes any and all information ("personal data") about you that you have provided or has been provided to us, within the framework of our legal obligations under the KVKK and other relevant legislation, in the manner and form prescribed by the law, and we hereby inform you that these personal data may be shared with competent authorities authorized to request such personal data under the law, and that any and all processes related to your information, including but not limited to its recording, storage, retention, modification, disclosure, and transfer, constitute "processing of personal data".

In this context, your personal data may be collected by TERRA POWER or real or legal persons processing data on behalf of TERRA POWER, in oral, written, or electronic form, through the methods listed below, without limitation:

  • Contact forms filled out electronically or physically,
  • Contracts, applications, forms, offers, photos, emails, faxes, letters, and documents,
  • Contact forms filled out to get in touch with us on our websites,
  • Cookies used to recognize you,
  • Third-party companies processing data on behalf of our company or supporting us in any phase of the membership program,
  • Our employees,
  • Social media channels, and the use of search engines such as Google, etc.

2. Processing of personal data and processing purposes

As the data controller, TERRA POWER may wholly or partially obtain, record, store, retain, modify, update, periodically review, rearrange, classify, and share your personal and/or special categories of personal data obtained with your explicit consent, through written communication channels, social media pages, and/or any other channels, and may keep them for the duration prescribed by the relevant legislation or necessary for the purposes of processing, and may share them with private or legal persons with whom TERRA POWER cooperates or is obliged to share according to the relevant legislation or service requirements.

The personal data collected is processed in accordance with the Law No. 6698 on the Protection of Personal Data and related legislation, for purposes such as the execution of commercial activities, the provision of services to our customers, recording your suggestions and complaints, ensuring the implementation of our company's human resources policies, providing legal and commercial security for our company and individuals in business relationship with our company, and determining and implementing commercial and business strategies.

3. Transfer of Personal Data

TERRA POWER will only share your personal data with our group companies, business partners, customers with whom we have contractual agreements, suppliers, auditing firms, or public institutions authorized to request such data under the security and privacy principles specified in Law No. 6698 and relevant legislation or with your explicit consent.

Rights of the Data Subject Listed in Article 11 of the Personal Data Protection Law (“Law”)

Under the Personal Data Protection Law, you have the following rights regarding your personal data:

  • a. To learn whether your personal data is being processed,
  • b. To request information if your personal data has been processed,
  • c. To learn the purpose of processing your personal data and whether it is being used in accordance with that purpose,
  • d. To learn the third parties to whom your personal data has been transferred, whether domestically or internationally,
  • e. To request the correction of any incomplete or inaccurate personal data,
  • f. To request the deletion or destruction of personal data in accordance with the conditions set forth in Article 7 of the Law,
  • g. To request that the third parties to whom your personal data has been transferred be informed of the processes carried out under subparagraphs (d) and (e) above,
  • h. To object to any negative consequences arising from the analysis of your personal data through exclusively automated systems,
  • i. To demand compensation for damages suffered due to the illegal processing of your personal data.

These are your rights under the law.

To exercise your rights under the Law No. 6698 on Protection of Personal Data, you can fill out the digital or printed "KVKK Application Form" document available at our company headquarters or at https://terrapower.com.tr.

  • You can personally deliver the document with a wet signature at the company's workplaces or through your representative with a special power of attorney.
  • You can send it via registered mail with return receipt.
  • You can send it through a notary public.
  • You can send your application signed with a secure electronic signature or mobile signature to our company's registered electronic mail address at [email protected] (KEP) or to [email protected], the electronic mail address previously notified to our company and registered in our system.

Depending on the nature of your request and the application method, additional verification measures (such as sending a message to your registered phone number or calling you) may be required by the Company to determine that the application belongs to you and to protect your rights.

As required by Article 13/2 of the KVKK Law, your applications sent to us will be responded within thirty days from the date of receipt of your request, depending on the nature of your request. Our responses will be sent to you in written or electronic form in accordance with the relevant provisions of the KVKK Law, Article 13. In case the process requires an additional cost, we reserve the right to request the expenses to be paid by you according to the tariff specified in Article 13 of the KVKK, entitled "Application to Data Controller".
